Terms and Conditions
This is a legally binding contract and contains a liability release of certain legal rights. By purchasing or reserving any lodging, trip itinerary, package, trip, or other services from us (referred to as “itinerary”, “trip itinerary,” “package” or “trip”), and paying a deposit, you accept all of the terms and conditions in this agreement on your own behalf and on behalf of all persons listed on your booking (“traveler” or “you”), including any minor under your custody, care or control, and direct us to perform services for each and every traveler.
Terms & Conditions of Your Costa Rican Vacation
Thank you for taking the time to read these Terms and Conditions. Together with your final itinerary, these Terms and Conditions set out the legally binding agreement between you and us for our Services and all communications you have with us before, during, and after your travel.
By using our Services, you accept these Terms and Conditions, and our providing you with Services is conditioned on your acceptance. If you do not accept these Terms and Conditions, please do not use our Services.
By purchasing an itinerary, you acknowledge that you have read the final version of the itinerary and agree to accept any and all products and services included in the total price.
The Section titled “Responsibility, Limitation of Liability and Liability Release” in these Terms and Conditions contains a waiver of certain rights that applies to all claims brought against us. Please read it carefully.
In these Terms:
- “We", “us,” or “our” refer to Corporación de Viajes Mundiales, S.A., a Panamanian corporation doing business as Costa Rican Vacations.
- “CRV” refers to Costa Rican Vacations.
- “Our Service” refers to the provision of travel consultancy and planning, creating “itineraries,” “trip itineraries,” “packages” and/or “trips,” and booking Travel Services through our website portal and other online tools, and our Travel Consultants.
- “Travel Services” refers to the travel services made available to you by the relevant Travel Provider(s) through our Service, such as stays at a property, flights, car rental, or things to do, etc.
- “Travel Provider” refers to the travel supplier making available the Travel Services to you through our Service.
- “You” refers to you, the traveler, using our Service or making a booking with our Service, and every person listed traveling with you and using our Service, whether or not they are listed on your final itinerary.
- “Peak Season” refers to the following time periods:
- December 15 through January 5, and
- the seven days prior to, and including, Easter Sunday.
- All prices quoted on the website, in the itinerary and through any other means of communication are in United States Dollars.

Non-Peak Season: If the arrival date in your itinerary is 35 days or less, we require full payment at the time of booking. If your arrival date is more than 35 days, you can select your preferred payment plan via your travel consultant and proceed with the payment amount stated there.
Peak Season: If any part of your trip that you book with us is during Peak Season, then final payment is due at least 65 days prior to your arrival date.
Payment Method: Payments to us may be made through wire transfers or by credit card (Visa, Mastercard, or American Express only). We do not accept personal or cashier’s checks.
If you pay for your trip by wire transfer, you must also submit a credit card as a backup payment method, and you agree that you are committed to purchasing that trip. Your credit card is not a “temporary hold.” Once you submit your credit card as a backup payment method, you cannot cancel your itinerary without penalty. If your arrival date is 35 days or less from the date you agree to purchase your trip, we are not able to accept wire transfers. If your arrival date is more than 35 days away, we must receive your wire transfer within three business days. If we do not receive the wire transfer within the specified number of days, we have the right, and you authorize us, to charge your credit card for the full price of the vacation.
Your credit card will be charged by Costa Rican Internet Services LLC and will appear on your credit card statement as “Namu Travel.”
Credit/Debit Card Chargebacks
We work hard to make our customers happy. If you are not pleased with our services for any reason, you agree not to file a chargeback with your credit card or debit card company before you have given us an opportunity to address the matter. By using our Services, you agree to work with us in good faith to resolve your dispute and that chargebacks are not the appropriate way to avoid our cancellation and refund policies.
Changes are defined as a cancellation that you make of any individual service on the purchased trip itinerary. You may make changes to your itinerary up to the date your final payment is due (65 days for Peak Season, and 35 days during other times). You can only make changes to individual services for which the service provider does not charge a penalty. Please check with your Travel Consultant as to whether your changes will incur a penalty. If there is a penalty as a result of your cancellation, we reserve the right to charge that to your credit card.
You may add additional items to your trip itinerary without charge or penalty, subject to availability.
You may change the dates of your itinerary if the original date of your trip does not fall within the full 100% penalty cancellation period (65 days for Peak Season, and 35 days during other times). Any change of dates is at our sole discretion and contingent upon the availability from each partner of the original itinerary. If there is a price increase due to the change of dates, you are responsible for the difference in cost. If your original itinerary included a non-refundable reservation, you may need to make an additional payment at the time of rebooking. You may change the dates of your trip itinerary one time only.
If you cancel your entire itinerary 35 days or more prior to your arrival date, we will apply a penalty of 10% of the cost of the total booked itinerary. The 10% penalty will be in the form of a non-refundable travel voucher that you can apply to future itineraries booked with us within 30 days of the date you canceled your original itinerary. A new minimum deposit payment must be made as indicated on our booking page, prior to the non-refundable voucher being applied to the itinerary.
If you cancel your entire itinerary less than 35 days prior to your scheduled arrival, you will be charged 100% of the cost of the total booked itinerary.
The following terms apply during Peak Season, which is:
- December 15 through January 5 of the following year; and
- The seven days prior to, and including, Easter Sunday
If you cancel your entire itinerary 65 days or more prior to your arrival date, we will apply a penalty of 10% of the cost of the total booked itinerary. The 10% penalty will be in the form of a non-refundable travel voucher that you can apply to future itineraries booked with us within 30 days of the date you canceled your original itinerary. A new minimum deposit payment must be made as indicated on our booking page, prior to the non-refundable voucher being applied to the itinerary.
If you cancel your entire itinerary less than 65 days prior to your scheduled arrival, you will be charged 100% of the cost of the total booked itinerary.
- We offer “Peace of Mind” (or POM) Coverage for most of our packages for a fee. You are not required to purchase POM Coverage. If your itinerary has POM Coverage, you are entitled to cancel your itinerary for any reason, or no reason at all, for a refund equal to 100% of the monies paid on your itinerary. The POM Coverage is subject to the following conditions:
- International flights and bookings for services that you make on your own, outside of the itinerary that we prepare for you, are NOT included in your POM Coverage.
- If your itinerary DOES NOT include dates between December 15 and January 5 of the following year, you must notify your Travel Consultant at least 14 days prior to your arrival date.
- If your itinerary includes dates between December 15 and January 5 of the following year, you must notify your Travel Consultant at least 35 days prior to your arrival date.
- Refunds will be credited to the same credit card that you used to make your purchase, or in the case of payments by wire transfer, we will wire the funds to the same account from which the payment came.
Flexibility and Changes by Us
We reserve the right to cancel, alter or modify any itinerary without prior notice for any reason, including but not limited to, for the safety and/or comfort of travelers and for circumstances of Force Majeure, which is defined below. This includes the right to replace or substitute accommodations, modify the order in which places are to be visited, and make other changes to the itinerary. You acknowledge that the amenities, accommodations, transportation, route, schedule, and other aspects of the itinerary may change without prior notice and without compensation/refund due to local circumstances or events, which may include mechanical breakdown, flight cancellations, illness, strikes, political disputes, weather, border crossing problems, and other unforeseeable factors. If, prior to departure, we make a significant change under this paragraph, we will, as soon as reasonably possible, notify you of available alternatives.
If we are forced to reschedule, postpone, or cancel your trip for any reason that is completely within our control, whether before or during your itinerary, we will let you know as soon as possible. In these circumstances, we may offer one or more of the following options within our discretion: a credit for the itinerary price, the option to rebook to a comparable itinerary, or a refund. For information on what happens where we make changes due to Force Majeure, see the “Force Majeure” section below.
If we advise you that we are canceling your trip itinerary, we may use reasonable endeavors to reimburse you for any payments that you have made reduced by 1) any and all non-refundable deposits, monies, and cancellation fees that we have paid to suppliers and other third parties to provide components of your trip (in many cases, it is not possible to obtain refunds from suppliers once we have forwarded deposits and other monies you have paid for your itinerary to them), and 2) other costs we incur. In great part for reasons of this nature, we strongly recommend you obtain travel insurance as explained elsewhere in this agreement. Note that if we alter, modify, postpone, or reschedule your trip or offer you a travel credit, such action does not constitute a “cancellation” of your itinerary by us.
We shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, by reason of delay in performance, or by non-performance of any of our obligations hereunder as a result of any actions that it takes or does not take under this section and under this Agreement.
Force Majeure
Costa Rican Vacations will not be deemed in breach of this agreement or otherwise liable to you, by reason of delay in performance or non-performance of any of its obligations under this agreement to the extent that any such delay or non-performance is due to any Force Majeure. “Force Majeure” means any circumstances beyond our reasonable control, including without limitation acts of God, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, typhoon, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labor strikes, requisition, sickness, quarantine, pandemic, epidemic, diseases and viruses that are known, unknown or novel such as coronavirus/Covid-19 (including any spread thereof), foodborne, airborne, and communicable illnesses and disease, government intervention of any kind that affect domestic and/or international travel, government restrictions or warnings, diplomatic or health organization (e.g., World Health Organization) warnings, border closings, weather conditions, and unforeseen circumstances.
In the unlikely situation of a Force Majeure event that prevents, significantly hinders, or makes it impossible for us or our Travel Providers to provide Travel Services, including but not limited to those listed or provided in your itinerary, we and/or our Travel Providers will be entitled to, in our sole and absolute discretion, cancel, alter, modify, postpone, or reschedule any itinerary or arrangement, including the itinerary dates and the entire itinerary itself, or take other actions that are reasonable under the circumstance. You understand and agree that we will not be able to pay you any compensation, costs, or expenses you incur as a result of a Force Majeure. We regret that no refunds will be provided if we take any of the preceding actions due to Force Majeure, unless and to the extent we are able to obtain any refunds from our Travel Providers upon your request.
Should you wish us to request refunds from our Travel Providers, you will be charged a nonrefundable fee for such services. Any refund under this section will be less our non-refundable administration and operational costs, and any and all non-refundable deposits and cancellation fees that we have paid to Travel Providers and other third parties to provide components of your trip. Our administration and operational costs in planning your itinerary are not refundable because of the work involved in planning, booking, and management of your itinerary from the moment your itinerary is booked.
This administration fee is a cost that we cannot recuperate, again because of the time and materials already invested in the itinerary. Please note that we are not obligated to seek refunds from suppliers, and in many instances, it is not possible to obtain refunds from suppliers once we have forwarded deposits for your trip to them. This policy is based on the fact that Travel Providers, who are typically located outside the United States, are not obligated to return non-refundable deposits or waive their cancellation fees in the case of Force Majeure. For reasons of this nature, we strongly recommend you obtain travel insurance. If you choose to cancel your itinerary—if we invoke Force Majeure, our standard cancellation penalties in the event you cancel will apply, unless we expressly state otherwise.
If Costa Rican Vacations is affected by Force Majeure, we, if practicable, will notify you of the nature and extent thereof.
This section applies where you have not elected to purchase POM Coverage, or POM Coverage is not applicable. You may request a refund for part or the full amount of your trip anytime prior to or after your arrival date. However, our cancellation policies will determine the amount to be refunded.
In order to process refunds, we will need written communication from you to your travel consultant.
Processing times for refunds will vary depending on the volume of requests and reimbursement schedules offered by the providers.
All approved refunds will be returned to the original credit card. If this is not possible for any reason, other arrangements will be made. Please note that once the refund was issued, it can take up to 10 business days to be reflected in your credit card statement.
Costa Rican Vacations recommends the purchase of travel insurance to help protect your vacation investment.
No refunds will be provided for any unused portion of a trip itinerary once the vacation begins, including but not limited to if you leave a vacation for any reason, miss days of the vacation or an activity, or have to be removed from a vacation. There are no exceptions to our cancellation and refund policy, including but not limited to Force Majeure.
For these reasons, we recommend that you purchase trip cancellation and international or travel medical insurance. Note, however, that some policies do not protect against cancellation and inconveniences due to pandemics or supplier defaults, so be sure to read your policy carefully and consult with the travel insurance company of your choosing.
We cannot provide insurance coverage advice. We recommend cancel for any reason (“CFAR”) coverage, which costs more and must be purchased within 7-14 days of the initial trip itinerary deposit or payment to any service provider in order to cover pre-existing conditions depending on the insurer.
It is your responsibility to ensure that everyone in your group has the appropriate documentation in their possession (such as current and valid passports, visas, and identification cards) before leaving, and that they satisfy all other applicable requirements (such as vaccinations, testing, or health insurance), to gain entry to Costa Rica and re-entry to your home country. Make sure to review the applicable documentation and other requirements prior to completing the purchase of travel services. Obtaining passports and visas may require lengthy processing times and it is your responsibility to ensure timely receipt of all documents.
To enter Costa Rica, a valid passport, and a pre-paid airline (or bus) ticket exiting the country are mandatory. Additional specific entry requirements depend on your country of citizenship. Currently, you may enter Costa Rica without a visa if traveling with a United States of America, Canadian, or most European passports. Immigration will then stamp your passport with your approved length of stay (usually 90 days). For other countries, a visa may be required. It is always best to contact the nearest Costa Rica Embassy for up-to-date entry and visa requirements.
You should conduct your own research and become informed about the destinations in your trip itinerary, including knowledge about any travel advisories and warnings issued by government authorities in your country. In the U.S., you can consult the U.S. State Department’s website at www.travel.state.gov or contact them by phone at the number specified on their website. You are responsible for protecting your own well-being and personal property before, during, and after your trip. This includes ensuring any and all vaccinations, inoculations, or prescribed medications are taken as directed by your local doctor and/or travel clinic for the areas visited.
We have no special knowledge of health hazards such as the risk of contracting Covid-19, either during your travel or at your destination. For the latest travel health information, you should review the State Department’s website at travel.state.gov and the CDC’s information at www.cdc.gov/travel, the government websites of your country, and/or the government website of your destination.
We are not responsible for Covid-19-related requirements that travel suppliers and governments may impose from time to time, such as health affidavit forms, health screenings prior to departure or upon arrival, face coverings, or quarantines. For the latest Covid-19 government travel regulations, you should review IATA’s website or in the U.S., the U.S. State Department’s website at www.travel.state.gov. Corporacion de Viajes Mundiales, S.A. is solely a travel agency and does not provide the actual tours, services, accommodations, etc., associated with our client’s vacations. Our Travel Providers, such as the carriers, hotels, vendors, tour providers, and other suppliers providing travel or other services available to the client on our website or booked directly with our company via telephone or other form of communication, are Independent Contractors and are not agents, employees, partners, or Affiliates of Corporacion de Viajes Mundiales S.A. and/or Costa Rican Vacations or any of its affiliates. Corporacion de Viajes Mundiales S.A. and/or any of its affiliates are not liable for the acts, errors, omissions, misrepresentations, warranties, breaches or negligence, financial default, or bankruptcy of any such third-party carrier, vendor, or supplier of services or for any personal injuries, death, property damage, or other damages or expenses that may result therefrom. Corporacion de Viajes Mundiales S.A. and its affiliates have no liability and will make no refund in the event that any third-party provider service results in any delay, cancellation, overbooking, strike, force majeure, or other causes beyond our direct control. Any issues arising in connection with such third-party carriers, vendors, etc., must be addressed directly with such third-party providers in accordance with the procedures required by such third party.
To the fullest extent permitted by law, you on your behalf, or as parent or legal guardian of a minor traveler, on behalf of yourself, the minor, your heirs, legal and personal representatives, next of kin, including your spouse, successors and assigns (individually and collectively, “Releasors”), expressly RELEASE, WAIVE, FOREVER DISCHARGE AND COVENANT NOT TO SUE Corporacion de Viajes Mundiales, S.A. (or any of its owners, shareholders, officers, employees, directors, representatives, independent sales agents, volunteers, successors, and assigns) (individually and collectively, “Released Parties”) in either a representative or individual capacity, in law or in equity, and you shall never cause a lawsuit to be brought against any of the Released Parties for any claims, demands, rights, or causes of action whatsoever arising from or relating to any known or unknown, foreseen or unforeseen, bodily and personal injuries, deaths, property damage, or consequences thereof arising out of, relating to, or in connection with your and or the minor’s participation in the itinerary, package, and/or trip arranged through or provided by for yourself and or the minor, whether arising from the Released Parties’ negligence or otherwise.
In the event that despite the limitation set forth above, Corporacion de Viajes Mundiales S.A. and/or any of its affiliates are found liable for any loss or damage which arises out of or in any way is connected with any of the occurrences described above, then the liability of Corporacion de Viajes Mundiales S.A. and/or its affiliates, will in no event exceed (i) the total amount paid by the client to Corporación de Viajes Mundiales S.A. and/or its affiliates for the services contracted for or (ii) the amount of $500 USD, whichever ever amount is greater.
The limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these terms is found to have failed of its essential purpose. The limitations of liability provided in these terms are inure to the benefit of Corporacion de Viajes Mundiales S.A. and/ or its affiliates.
You agree to defend and indemnify Corporación de Viajes Mundiales S.A. and/or its affiliates and any of their officers, directors, employees, and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties, or other costs or expenses of any kind or nature including but not limited to reasonable legal fees, brought by third parties as a result of:
(a) your breach of this Agreement;
(b) your violation of any law; or the rights of a third-party vendor, carrier, provider;
(c) your violation of the rights of a third-party vendor, carrier, or provider; or
(d) your violations of the rights of any other third party, including other travelers.

Class Action Waiver And No Punitive Damages
You are waiving your right to serve as a representative, litigant, or in any other representative capacity, and/or to participate as a member of a class of claimants, in any lawsuit/arbitration filed against us. In no event shall we be liable for or pay punitive damages.
You agree that this agreement shall be interpreted according to the laws of Panama.
Jurisdiction over any dispute arising out of, in connection with, or relating to this agreement and/or the transactions and relationships among the parties contemplated by this agreement shall be filed exclusively in a court of competent jurisdiction in San Jose, Costa Rica. You agree to personal jurisdiction in the specified forum. If any portion of this agreement is determined by a court to be null and void, the remaining portions of this agreement shall nevertheless remain valid and binding upon the parties. You also agree that this agreement is intended to be as broad and inclusive as permitted under applicable law. You agree that if any portion of this agreement is found to be void or unenforceable, the remaining provisions shall remain in full force and effect.
We may on occasion amend these Terms, and we reserve the right to update or alter these Terms at any time. Any amendment will take effect and be deemed to have been accepted by you seven days after being posted to our website, immediately upon notice to you in writing by email or mail, or upon your continued use of our services or participation on one of our trip itineraries, whichever occurs first. We recommend that you refer to these Terms prior to travel to familiarize yourself with the most up-to-date version available.
This agreement is the final, complete, and exclusive statement of the parties’ agreement on the matters contained in this agreement. It supersedes all previous negotiations and agreements.
